The documents and materials provided through our services are intended to assist individuals in preparing their own estate planning documents based on the information they provide. These documents are not reviewed, approved, or validated by an attorney unless the client independently engages one. 

Because estate planning laws vary by state and individual circumstances, clients are strongly encouraged to have their completed documents reviewed by a licensed attorney before signing or relying upon them.

By using our services, you acknowledge and agree that: 

  • You are responsible for determining whether the documents meet your personal needs and legal objectives. 
  • You understand that My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas do not review documents for legal sufficiency, accuracy, or compliance with state law
  • You assume full responsibility for the legal effect and consequences of any documents you create or execute.

Failure to obtain legal review does not create liability for My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas regarding the validity, enforceability, or effectiveness of any documents prepared through our services. 

3.3 Client Responsibility for Information Provided 

Clients using the services of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas acknowledge and agree that they are solely responsible for the accuracy, completeness, and truthfulness of all information they provide. 

Our services rely entirely on the information supplied by the client when preparing estate planning documents. We do not independently verify the information provided, including but not limited to: 

  • Names of individuals 
  • Beneficiary designations 
  • Property descriptions 
  • Asset information 
  • Trustee selections 
  • Distribution instructions 
  • Marital or family status 
  • Any other personal or financial information 

Because the documents are generated based on the information provided by the client, any errors, omissions, or inaccuracies in that information may affect the validity or effectiveness of the documents

By using our services, you acknowledge and agree that: 


  • You are responsible for reviewing all documents carefully before signing them. • You are responsible for ensuring that all information entered is accurate and complete.
  • My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are not responsible for errors resulting from incorrect or incomplete information provided by the client
  • Any corrections or updates to documents resulting from inaccurate information may require additional preparation or fees. 

Clients are strongly encouraged to carefully review all information and consult with a licensed attorney if they have questions about how their information may affect their estate planning documents. 

3.4 No Guarantee of Legal Outcome or Document Effectiveness 

Clients using the services of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas acknowledge and agree that no guarantees, warranties, or representations are made regarding the legal outcome, effectiveness, or enforceability of any estate planning documents prepared through our services. 

Estate planning laws vary by state and are subject to change. In addition, the effectiveness of estate planning documents may depend on many factors outside of our control, including but not limited to: 

  • Changes in state or federal law 
  • Court interpretation of legal documents 
  • Proper execution, witnessing, and notarization of documents 
  • Changes in personal or financial circumstances 
  • Asset titling or beneficiary designations 
  • Actions taken after documents are created 
  • Future family or estate disputes 

Because of these factors, My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas cannot guarantee that any document will: 

  • Avoid probate 
  • Achieve specific tax outcomes 
  • Prevent legal challenges 
  • Be accepted or interpreted in a particular way by a court 
  • Achieve any particular estate planning objective 

Clients acknowledge that estate planning outcomes ultimately depend on many legal and factual circumstances beyond the preparation of documents alone. 

For the highest level of legal certainty, clients are encouraged to have their estate planning documents reviewed by a licensed attorney and to periodically review their estate plan as laws and personal circumstances change.

By using our services, clients agree that My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas shall not be liable for any legal outcomes, probate results, tax consequences, or disputes arising from the use or interpretation of documents prepared through our services. 

3.5 No Third-Party Reliance / No Beneficiary Rights 

The services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are intended solely for the benefit of the individual client who engages our services. 

No third party, including but not limited to: 

  • heirs 
  • beneficiaries 
  • family members 
  • trustees 
  • executors 
  • creditors 
  • or any other person or entity 

shall have any right to rely upon, enforce, or assert claims relating to the services provided or the documents prepared through our services. 

Estate planning documents are prepared based on the instructions and information provided by the client at the time services are performed. Because estate plans often affect individuals who are not present during the preparation process, those individuals may disagree with the client’s decisions or the structure of the documents. 

By using our services, clients acknowledge and agree that: 

  • Our services are provided exclusively for the client requesting the documents
  • No third party is an intended beneficiary of our services. 
  • No third party shall have any right to bring a claim against My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas relating to the preparation or use of any documents. 

This limitation applies to any claims that may arise before or after the client’s death, including claims relating to the interpretation, enforcement, or outcome of estate planning documents.

3.6 No Financial, Tax, or Investment Advice 

The services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are limited to general educational information and document preparation assistance related to estate planning. 

Nothing provided through this website, during consultations, or through any communication with My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas should be interpreted as: 

  • Financial advice 
  • Tax advice 
  • Accounting advice 
  • Investment advice 
  • Legal advice 
  • Recommendations regarding specific financial strategies

Clients agree that they are solely responsible for seeking independent professional advice regarding financial, tax, or investment matters.

4. Not a Law Firm 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are not a law firm and do not provide legal advice or legal services. 

The services offered through this website may include information about estate planning, living trusts, wills, and related services. 

Use of this website does not create an attorney-client relationship. 

If you require legal advice, you should consult with a licensed attorney in your state. 

5. Use of Estate Planning Documents 

If estate planning documents, templates, or related services are provided through this website: 

  • They are intended for self-directed use 
  • They may not be appropriate for every situation

6. Payment Authorization and Acceptance of Terms 

By submitting payment for services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas, the client acknowledges that they have read, understood, and agreed to these Terms and Conditions. Payment for services constitutes full acceptance of all policies described herein, including all service, travel, scheduling, and non-refund provisions. Clients agree that payment authorizes the commencement of document preparation, consultations, scheduling, and travel arrangements. Once payment is received and services begin, the payment is considered earned in accordance with these Terms and Conditions.

7. Payment Disputes and Chargeback Policy 

Clients agree that all payments made for services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas represent payment for professional services including document preparation, consultations, scheduling, and travel commitments. 

Clients agree not to initiate or attempt to initiate credit card chargebacks, payment reversals, or payment disputes for services that have been performed in accordance with these Terms and Conditions. 

If a payment dispute, chargeback, or reversal is initiated with a financial institution or payment processor for services that have already been performed, the client agrees that: 

  • the dispute may be contested using documentation including these Terms and Conditions and service records 
  • the client remains responsible for the full payment amount owed • the client may be responsible for any administrative fees, collection costs, or chargeback fees incurred as a result of the dispute 

Initiating a payment dispute does not cancel or void the client’s financial obligation for services performed. 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas reserve the right to pursue recovery of unpaid balances through lawful collection methods if necessary. 

8. Non-Refundable Service & Travel Completion Clause 

All estate planning services require full payment in advance.  

All services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas require full payment prior to the commencement of any work, including but not limited to document preparation, consultations, scheduling, and travel arrangements. 

If a third party (including a family member, child, caregiver, or other individual) submits payment or engages services on behalf of the signing client, that person acknowledges and agrees that they are financially responsible for the full payment of services and that all payments remain non-refundable in accordance with these Terms and Conditions, regardless of whether the signing client ultimately signs the prepared documents. 

All payments made for estate planning services are deemed fully earned upon the commencement of services and are non-refundable.

Work is considered to have commenced once any of the following occurs: 

  • document preparation has started 
  • client information has been collected and reviewed 
  • consultations or planning meetings have taken place 
  • travel to a client’s residence, care facility, or other meeting location has begun • scheduling and preparation for document execution has been completed 

Clients acknowledge and agree that travel time, preparation time, and in-person meetings constitute completion of services, regardless of whether estate planning documents are ultimately signed or executed. 

If My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas travels to a client’s residence or any other location, including but not limited to: 

  • private residences 
  • assisted living facilities 
  • nursing homes 
  • long-term care facilities 
  • short-term rehabilitation facilities 
  • hospitals 
  • memory care facilities 
  • hospice facilities 

and the client or signing party refuses, declines, or is unable to sign the prepared documents for any reason, the services shall be deemed fully performed, and no refunds, discounts, credits, or reimbursements shall be issued

This policy applies regardless of the reason the documents are not signed, including but not limited to: 

  • the client changing their mind 
  • objections from family members 
  • the client declining to proceed 
  • the client being unwilling to sign 
  • the client lacking legal capacity at the time of signing 
  • facility restrictions or scheduling issues 
  • any other circumstance outside the control of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas. 

If an additional appointment is requested after an initial visit has occurred, including situations where documents were not signed during the first visit, a minimum return service fee of $200, or the current applicable travel/service fee, whichever is greater, will apply.

Additional visits may also be subject to: 

  • travel fees 
  • expedited service fees 
  • scheduling fees 
  • additional document preparation fees if revisions are requested 

Clients further acknowledge that document preparation services, travel time, and scheduling commitments represent substantial professional time and resources, and therefore all payments remain fully earned once services begin

Document Revisions and Modifications 

Estate planning documents are prepared based on the information provided by the client at the time services are requested. If a client requests changes, corrections, updates, or revisions to documents after preparation has begun or after documents have been completed, additional service fees may apply. My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas reserve the right to charge reasonable fees for document revisions, additional consultations, or re-preparation of documents.

By engaging the services of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas, the client agrees to these terms and accepts full financial responsibility for the services provided. 

9. Notarization and Document Execution Acknowledgment 

Clients acknowledge that any notarization services provided in connection with estate planning documents are performed solely for the purpose of verifying the identity of the individual signing the documents and witnessing the execution of those documents as required by law. 

Notarization does not constitute legal advice, legal review, or certification that the contents of any document are accurate, legally sufficient, or appropriate for the client’s personal circumstances. 

By signing or notarizing estate planning documents, the signing individual acknowledges that: 

  • they have had the opportunity to read and review the documents prior to signing • they understand the general nature and purpose of the documents being executed 
  • they are signing the documents voluntarily and of their own free will • they are not signing under coercion, pressure, or undue influence from any person 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas do not make medical or legal determinations regarding a person’s mental capacity and are not responsible for evaluating a signer’s legal competency beyond the standard observations required during document execution. 

If at any time it reasonably appears that a signer may not understand the nature of the documents or the consequences of signing them, notarization or document execution services may be postponed or declined at the sole discretion of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas. 

Clients acknowledge that notarization or witnessing of documents does not guarantee the legal enforceability or validity of any estate planning document. 

10. Scheduling, Facility Access, and Client Availability 

Clients engaging the services of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are responsible for ensuring that all necessary arrangements are made for scheduled meetings, document signings, and in-person consultations. 

This includes ensuring that the signing party is: 

  • available at the scheduled appointment time 
  • willing and prepared to sign the documents 
  • physically present at the agreed-upon location 
  • permitted by the facility or property to meet with the service provider 

Clients are also responsible for coordinating access with any third parties who control entry to the meeting location, including but not limited to: 

  • assisted living facilities 
  • nursing homes 
  • rehabilitation centers 
  • hospitals 
  • memory care facilities 
  • hospice facilities 
  • gated communities 
  • private residences requiring authorization

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas are not responsible for delays, cancellations, or inability to complete document signings caused by: 

  • facility restrictions or policies 
  • denial of entry by facility staff 
  • scheduling conflicts or delays by the client or family members 
  • the client being unavailable, asleep, medicated, hospitalized, or otherwise unable to participate 
  • lack of cooperation from family members, caregivers, or facility personnel • failure to obtain facility permission for document signing 
  • any other circumstance outside the control of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas. 

If the scheduled appointment cannot proceed due to any of the circumstances above, the appointment shall still be considered fulfilled for purposes of service completion, and the Non-Refundable Service & Travel Completion Clause shall apply. 

Any additional visit required to complete the signing will be treated as a new service appointment and will be subject to the minimum return service fee of $200, or the current applicable travel/service fee, whichever is greater, along with any applicable travel or service charges. 

Clients are encouraged to confirm in advance that the signing party is available, willing, and able to participate at the scheduled time, and that the location permits outside visitors and document signings. 

11. Third-Party Interference and Obstruction of Services 

Clients acknowledge that estate planning services provided by My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas may involve coordination with third parties including family members, caregivers, facility staff, medical personnel, or other individuals present during meetings or document signings. 

Clients agree that third parties who are not the signing client do not control or direct the services provided, and any attempt by a third party to interfere with, obstruct, delay, or prevent the preparation or execution of estate planning documents does not alter the client’s financial obligations under these Terms and Conditions. 

Interference may include, but is not limited to: 

  • Family members attempting to control the estate planning decisions of the signing client 
  • Facility staff denying access after appointments have been scheduled • Individuals interrupting or obstructing document execution
  • Third parties attempting to influence the signing client against their expressed wishes • Disputes among family members regarding the client’s estate planning decisions 

If interference or obstruction by a third party occurs, My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas reserve the right to suspend, postpone, or terminate the appointment at their sole discretion. 

Such circumstances shall not constitute a failure to perform services, and all payments made for document preparation, consultations, scheduling, and travel shall remain fully earned and non-refundable in accordance with these Terms and Conditions. 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas shall not be responsible for resolving disputes among family members, caregivers, or other third parties regarding the client’s estate planning decisions. 

Recording and Documentation of Meetings 

Clients and any individuals present during meetings or document signings acknowledge that audio or video recording of consultations, meetings, or signing appointments may not occur without the consent of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas. 

Unauthorized recording of meetings, consultations, or document execution appointments is prohibited. 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas reserve the right to suspend or terminate any meeting or appointment if unauthorized recording occurs.

12. Client Capacity, Voluntary Participation, and Third-Party Payment Acknowledgment 

Clients engaging the services of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas acknowledge and agree that estate planning decisions must be made voluntarily and without coercion or undue influence from any third party. 

In many situations, a family member or other third party may request services or pay for estate planning documents on behalf of the individual who signs the documents. In such cases, the person whose estate planning documents are being prepared is considered the decision-making client, even if another individual pays for the services. 

The paying party acknowledges and agrees that: 

  • payment for services does not grant authority to control or direct the estate planning decisions of the signing client 
  • the signing client’s wishes, instructions, and decisions regarding their estate plan control the preparation of documents 
  • the paying party may not pressure, influence, or attempt to control the signing client’s estate planning decisions 

The signing client represents that they are acting of their own free will and that their decisions regarding the preparation and execution of estate planning documents reflect their personal wishes and intentions. 

My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas do not make legal determinations regarding a client’s mental capacity. However, if during a meeting or document signing it reasonably appears that the client may not understand the nature of the documents or the consequences of signing them, services may be postponed or declined at the sole discretion of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas. 

If undue influence, coercion, or lack of voluntary participation is suspected, services may be discontinued immediately. 

When a third party has paid for services, the paying party acknowledges that payment remains fully earned and non-refundable in accordance with these Terms and Conditions, even if the signing client later declines to sign the prepared documents. My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas shall not be responsible for disputes among family members, beneficiaries, heirs, or other interested parties regarding the client’s estate planning decisions.

13. User Responsibility 

By using this website, you agree that: 

  • You are responsible for the accuracy of any information you provide • You will use this website only for lawful purposes 
  • You will not attempt to gain unauthorized access to the website, systems, or servers 
  • You will not interfere with the proper functioning of the website

Clients acknowledge and agree that the preparation of estate planning documents is based solely on the information provided by the client and that My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas shall not be responsible for outcomes resulting from inaccurate, incomplete, or changing information provided by the client. 

To the fullest extent permitted by applicable law, the total liability of My Wills and Trust Specialist, TWH Living Trust, and Allan G. Vargas, if any, for any claim arising out of or relating to services provided shall not exceed the amount paid by the client for the services giving rise to the claim.

18. Internet Security 

While we take reasonable steps to protect information submitted through this website, no internet transmission is completely secure. 

Use of this website and submission of information is done at your own risk. 

19. Mandatory Arbitration and Dispute Resolution 

By using this website or engaging the services of My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas, you agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, the use of this website, or

  • services provided 
  • estate planning documents prepared 
  • consultations or communications 
  • or these Terms and Conditions 

shall be resolved through binding arbitration, rather than through litigation in court, except where prohibited by law. 

Informal Resolution First 

Before initiating arbitration, the parties agree to attempt to resolve any dispute informally. 

Clients agree to contact My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas and provide written notice of the dispute, including a description of the issue and the requested resolution. The parties agree to attempt good-faith negotiations for a period of at least 30 days before initiating arbitration proceedings. 

Binding Arbitration 

If the dispute cannot be resolved through informal negotiations, the matter shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) or another mutually agreed arbitration provider. 

Arbitration shall be conducted in accordance with the Consumer Arbitration Rules of the American Arbitration Association, unless otherwise agreed by the parties. 

Arbitration Location

All arbitration proceedings shall take place in Orange County, California, unless both parties agree to an alternative location. 

Waiver of Jury Trial 

The parties acknowledge that arbitration replaces the right to file a lawsuit in court and replaces the right to have claims decided by a judge or jury. 

No Class Actions 

All claims must be brought solely on an individual basis

Clients agree that they may not bring claims against My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas as part of: 

  • a class action 
  • a collective action 
  • a representative action 
  • or any other group proceeding 

The arbitrator shall have no authority to combine or consolidate claims from multiple parties. 

Arbitration Authority 

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. 

The arbitrator may award damages or relief only to the extent permitted under applicable law and these Terms and Conditions. 

Governing Law 

This arbitration agreement and any disputes arising from the use of this website or services shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles. 

Severability 

If any portion of this arbitration provision is determined to be unenforceable, the remaining portions shall remain in full force and effect.

20. Limitation Period for Claims (Statute of Limitations) 

To the fullest extent permitted by applicable law, any claim, dispute, or cause of action arising out of or related to: 

  • the use of this website 
  • services provided by My Wills and Trust Specialist, TWH Living Trust, or Allan G. Vargas 
  • estate planning documents prepared 
  • consultations or communications 
  • or these Terms and Conditions must be filed within one (1) year after the date the claim or cause of action arises, or such claim shall be permanently barred. • This limitation period applies regardless of the legal theory asserted, including but not limited to claims based on: 
  • contract 
  • negligence 
  • misrepresentation 
  • statutory claims 
  • or any other legal or equitable theory. 

Clients acknowledge that estate planning matters may affect family members, beneficiaries, or other third parties after the client’s death. However, any claim relating to services provided must still be brought within the one (1) year limitation period described above. If any applicable law prohibits the shortening of the statute of limitations for a particular claim, then the claim must be brought within the shortest time period permitted by law. 

21. Governing Law 

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles. 

Any disputes related to the use of this website shall be resolved in the appropriate courts located within the State of California. 

22. Changes to These Terms 

We reserve the right to modify these Terms and Conditions at any time. 

Updates will be posted on this page with the revised date. Continued use of the website after updates indicates acceptance of the revised Terms.
